GENERAL PROVISIONS

§1

  1. These regulations of the newsletter service (hereinafter referred to as the “Regulations”) define the rules for using the newsletter service (hereinafter referred to as the “Newsletter service”) and the processing of personal data of users using this service (hereinafter referred to as “Users”).
  2. These Regulations are addressed to Users who are both consumers and entrepreneurs. The provisions of these Regulations are not intended to exclude or limit any of the rights of consumers under mandatory provisions of law – any possible doubts are resolved in favor of the consumer. In the event of inconsistency between the provisions of these Regulations and the above provisions, these provisions shall prevail.
  3. The newsletter service is provided by KMK INWESTYCJE spółka z ograniczoną odpowiedzialnością with its registered office in Mielec, ul. Mickiewicza 17, 39-300 Mielec, entered into the register of entrepreneurs of the National Court Register under KRS number: 0000617452, REGON: 180858252, NIP: 8172179911 (hereinafter referred to as: “Company” or “Service Provider”).
SUBJECT OF THE SERVICE

§2

  1. The newsletter service is an electronic distribution service under which the Company sends information in the form of an electronic letter (e-mail), hereinafter referred to as the “Newsletter”, via e-mail to the e-mail address provided by the User.
  2. The newsletter service is provided free of charge for an indefinite period of time or until the User resigns from further use of this service or until the Company terminates the provision of the newsletter service, which may occur at any time. When suspending or terminating the provision of the newsletter service, the Company is obliged to inform Users of this fact in advance by means of sending a message to the e-mail addresses provided by them.
  3. The newsletter is sent out periodically.
  4. The subject of the Newsletter includes information about products and services offered by the Company in connection with the operation of the Aparthotel Renesans facility located in Zakopane at the following address: ul. Tytusa Chałubińskiego 26, 34-500 Zakopane (hereinafter also referred to as the “Facility”), including news and novelties in the offer as well as current promotions and special offers, but also other information regarding the Company and the Facility, in particular regarding organized events, promotional campaigns, competitions, etc. related to the above-mentioned activities at the Facility.
TERMS OF USE

  1. The newsletter service can be used by a natural person, a legal person acting through an authorized person, or an organizational unit without legal personality, which has been granted legal capacity by law and has full legal capacity (hereinafter also referred to as: “Service Recipient”). If the Service Recipient is a natural person with limited legal capacity, if necessary, he/she undertakes to obtain legally effective consent of his/her legal representative to conclude an agreement for the provision of the newsletter service (hereinafter also referred to as: “Agreement”) and to provide such consent at each request of the Service Provider, however, as a rule, the Agreement has the character of a contract commonly concluded in minor, current matters of everyday life.
  2. In order to properly and fully use the newsletter service, Users should be in possession of:
    – a device with access to the Internet;
    – an active, valid e-mail account;
    – software enabling access to an e-mail account;

    Firefox, Chrome, Internet Explorer browser or software with similar parameters. The newsletter service is provided to Users who have consented to it in electronic form via the form available on the website: https://renesans.pl.

  3. Activities related to ordering the newsletter service include:
    providing the User’s e-mail address in the form available on the website https://renesans.pl and checking the appropriate checkbox confirming the willingness to subscribe and receive the Newsletter along with the commercial information contained therein sent by the Company;

    acceptance of these Regulations (acceptance is necessary to order the newsletter service).

    Expressing the willingness to subscribe to the Newsletter and accepting these Regulations results in concluding a contract for the provision of the newsletter service between the User and the Service Provider, resulting in adding the User’s e-mail address (e-mail address) to the e-mailing list; since then, the User’s e-mail address is used by the Company to provide the newsletter service.
  1. The User is obliged to enter data consistent with the actual situation, and, should they change, they are obliged to update them.
  2. The Company has the right to delete an incorrect or non-existent e-mail address provided by the User.
  3. Since the commencement of use of the newsletter service, the User is obliged to comply with these Regulations.
  4. The User is obliged to use the newsletter service in a manner consistent with the law and good practices, taking into account respect for personal rights, protection of personal data and the rights of other Users and third parties, including copyrights and intellectual property rights. Illegal actions that may impede the functioning of the Newsletter or expose the Company to criminal liability or loss of reputation are prohibited.
  5. When using the newsletter service, it is prohibited to provide or transmit illegal content, in particular in correspondence with the Company or in the registration form.
  6. The User may, at any time, without providing a reason and without incurring any costs, change the previously indicated e-mail address (e-mail address) to which the Newsletter is sent, by sending a declaration in this regard to the e-mail address: recepcja@renesans.pl or unsubscribe from the newsletter service (terminate the service provision agreement) by sending a declaration on this subject to the e-mail address: recepcja@renesans.pl or by clicking on the link in the footer of the Newsletter message, selecting the “Unsubscribe” button. Termination and cessation of sending information to the provided e-mail address has immediate effect and is indicated by a message confirming the operation.
PERSONAL DATA

§4

  1. The administrator of personal data of persons using the services provided by KMK INWESTYCJE ltd, with its registered office in Mielec in connection with the operation of the Aparthotel Renesans facility located in Zakopane, including Users’ data provided in connection with the use of the newsletter service, is KMK INWESTYCJE ltd based in Mielec, ul. Mickiewicza 17, 39-300 Mielec, entered into the register of entrepreneurs of the National Court Register under KRS number: 0000617452, REGON: 180858252, NIP: 8172179911.
  2. All detailed information regarding the rules of use of the website located under the domain: https://renesans.pl/ and its subpages, in particular information about the cookies used, information on the method and purpose of processing personal data collected within the website (also in connection with the provision of the newsletter service), as well as obtained through other channels (e.g. telephone contact or e-mail), are specified in the Privacy Policy.
COMPLAINTS, OUT-OF-COURT DISPUTES RESOLUTION

  1. The User may submit reservations related to the provision of the newsletter service in the form of a complaint. Complaints can be submitted in person at the reception of the Aparthotel Renesans facility, in writing to the address of this facility, or electronically to the following address: recepcja@renesans.pl, with the note: “Complaint”.
  2. A complaint regarding irregularities in the provision of electronic services shall, although this is not a requirement for considering the complaint, include: data enabling the Company to contact the Customer, including at least an e-mail address, a description of the irregularity, specifying the circumstances, date of occurrence and, if possible, the content of the message about the error, indication of the name and version of the web browser and the name and version of the Service Recipient’s operating system.
  3. Information about the processing of the complaint will be provided to the complainant in writing or electronically (e-mail) to the contact details provided by the complainant within the time frame in accordance with generally applicable regulations.

§6

  1. Every Consumer has the right to pursue out-of-court methods of dealing with complaints and pursuing claims. Detailed information regarding the possibility for a Customer who is a consumer to pursue out-of-court methods of dealing with complaints and pursuing claims, as well as the rules of access to these procedures, are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of the Trade Inspection and at the following Internet addresses of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php; http://www.uokik.gov.pl/sprawy_zdrowie.php; http://www.uokik.gov.pl/wazne_adresy.php.

  2. In the event of an out-of-court dispute involving a Customer who is a consumer, the ODR online platform, available at: http://ec.europa.eu/consumers/odr/, may also serve to resolve the dispute. The use of extrajudicial means of dealing with complaints and pursuing claims is voluntary and may only take place if both parties to the dispute consent to it. The above provision is for informational purposes only and does not mean the Company’s consent by default to participate in extrajudicial methods of dealing with complaints and pursuing claims (resolving disputes).

  3. Any disputes arising between the Company and a User who is not a consumer within the meaning of Art. 221 of the Civil Code, will be resolved by a common court competent for the seat of the Service Provider.

CHANGE IN THE REGULATIONS

§7

  1. The Company reserves the right to change these Regulations in the event of an important reason understood as (closed catalogue):
    – change in the way the service is provided due to technical or technological reasons;

    – a change in the legal provisions regulating the sale of products or the provision of services by electronic means by the Service Provider, affecting the mutual rights and obligations specified in the contract concluded between the User and the Service Provider or a change in the interpretation of the above legal provisions as a result of court rulings, decisions, recommendations or recommendations of offices or bodies competent in a given field;

    – changing the scope or method of providing the service to which the provisions of the Regulations apply, by introducing new, modifying or withdrawing existing functionalities covered by the Regulations by the Service Provider.
  2. The User will be informed about the content of changes to the Regulations by information about the changes being posted to the Regulations on the website https://renesans.pl. The User will be additionally notified about changes to the Regulations by information about the changes being sent out via the Newsletter to the e-mail address provided during registration.
  3. Changes to the Regulations enter into force on the date given along with the information about its change, but not earlier than 14 calendar days from the moment of notification of the changes to the Regulations, on condition that the amended Regulations will be binding on the User, provided that within 14 days from the date of receipt of information about its change, they will not have declared resignation from the newsletter service in the event of non-acceptance of the new content of the Regulations.
FINAL PROVISIONS

§8

  1. Individual newsletters constitute works within the meaning of the Act of February 4, 1994 on copyright and related rights and are protected. Any copying, modification and use of the content contained in the newsletter in a manner inconsistent with its intended purpose or without the Company’s consent may constitute a violation of the law.

  2. These Regulations are available free of charge at https://renesans.pl/regulamin-newsletter/ in a form that enables the acquisition, reproduction and recording of content using the IT system used by the User.

  3. In matters not regulated by these Regulations, generally applicable provisions of Polish law shall apply, in particular the provisions of the Civil Code and other relevant legal acts, as well as internal regulations in force at the Facility.

  4. The Regulations enter into force on April 1, 2024.
